Multiple Misdiagnoses of HER2 Breast Cancer at Atrium Health Wake Forest Baptist
Multiple Misdiagnoses of HER2 Breast Cancer at Atrium Health Wake Forest Baptist
Cancer patients from North Carolina underwent radical, irreversible HER2 cancer treatments, only to find out they had been misdiagnosed. Now, Grant & Eisenhofer is representing these women in seeking justice for their suffering and to hold accountable for its abject failures.
When you hear the words, “You have HER2 positive breast cancer,” a flood of emotions likely follows. Next come the extensive treatments, therapies, and tests. Side-effects from those treatments may have manifested in depression, anxiety, hair loss, memory loss, and neuropathy. Painful, permanent treatments such as hysterectomy and mastectomy may also have been prescribed. Your life is turned upside down.
For many cancer patients under the care of the staff at Atrium Health Wake Forest Baptist medical center in North Carolina, the diagnoses they received were wrong and treatments they endured were unnecessary. The women’s health attorneys at Grant & Eisenhofer recently filed a complaint on behalf of a woman who was misdiagnosed with HER2 positive breast cancer in her late 20s. She was treated at Atrium Health, including undergoing a hysterectomy, chemotherapy, chemo-immunotherapy, post-surgical KADCYLA® infusions, CT and MRI scans, and a double mastectomy. Years later, she was told that the treatments she endured weren’t needed, and that she could “discuss the ramifications of the misdiagnosis and mistreatment with the Risk Management Department.” Meanwhile, her dreams of having a family were completely dashed.
Just weeks after the complaint was filed, another woman—a grandmother diagnosed with HER2 breast cancer in 2020 when she was 59—filed a complaint with the North Carolina Department of Health and Human Services concerning her misdiagnosis. G&E is representing this woman as well, who endured 13 rounds of chemotherapy at Atrium Health before she was informed in May 2024 that she in fact did not have HER2.
These women represent only two of potentially many more patients misdiagnosed with HER2 breast cancer at Atrium Health. This type of cancer, particularly HER2 positive breast cancer, typically requires more aggressive treatments than HER2 negative. We fear that there may be many more patients who were misdiagnosed and received these permanent, life-altering treatments unnecessarily. Some patients went years before being told by Atrium Health they were misdiagnosed with HER2 positive breast cancer, when they actually did not have a positive HER2 diagnosis.
